Tassie Devil Labradoodles Planning Appeal

Northern Midlands Council advises that the Tasmanian Civil & Administrative Appeals Tribunal (“TASCAT”) has released a decision in relation to labradoodle breeder, Tassie Devil Labradoodles, of Perth.

While Council previously considered Tassie Devil Labradoodles to fall within the ‘home occupation’ exemption pursuant to the Tasmanian Planning Scheme – Northern Midlands (“Scheme”), the TASCAT decision released on 6 October 2023 has determined this exemption does not apply and that Home Occupation does not apply to a prohibited use under the scheme, including Domestic Animal Breeding.

TASCAT ordered that Tassie Devil Labradoodles is precluded from using the property at Perth for:

  1. the use of domestic animal breeding;
  2. from keeping pregnant dogs at the property; and
  3. offering for sale dogs bred for the purpose of sale.

“Council, as the relevant planning authority, is required to enforce the Scheme” said Mayor Knowles. “Council will now take steps to enforce the TASCAT decision and orders”.
